Terms of service
1. Acceptance
By downloading, installing, or using Park Sorted (the “App”) — the iPhone app or the web app at parksorted.com — you agree to these Terms of Service (“Terms”). If you don't agree, don't use the App.
Park Sorted is published by David Jackson trading as Create A Little Good (“we”, “us”), a sole-trader business based in New South Wales, Australia.
2. What Park Sorted does
Park Sorted is an AI-powered convenience tool. You point your phone's camera at a parking sign, we read the signs with a vision model, and we show you a plain-English verdict about whether you appear to be able to park there.
That's it. Park Sorted is a convenience tool, not:
- A legal authority
- A substitute for reading the physical sign
- A guarantee that you won't get a fine, tow, or clamp
- Parking-enforcement software of any kind
3. Accuracy disclaimer — read this
Park Sorted can and will be wrong sometimes.
- AI vision models make mistakes, especially when signs are dirty, obscured, partially occluded, poorly lit, damaged, or hand-modified.
- Parking rules change. A sign that was legal yesterday might have been updated overnight and our interpretation might lag.
- Multi-sign poles with conflicting rules are hard even for humans. We try to interpret them sensibly but we can be wrong.
- Our verdicts reflect the signs we can see in the frame — if you didn't capture a sign that applies, our answer won't account for it.
- When a reading is uncertain, or something on the pole needs a closer look, the verdict says so with a Double-check this scan warning. Pay attention to it. No warning does not mean the verdict is certain.
You are responsible for your own parking. Always read the physical sign. If the Park Sorted verdict and your own reading of the sign disagree, trust the sign, not the app.
4. No legal advice
Nothing in Park Sorted constitutes legal advice or a legal opinion about traffic law, parking enforcement, or your rights. If you're unsure about a specific parking situation, consult a lawyer or your local council.
5. Your responsibilities
You agree to:
- Use Park Sorted only in a safe, lawful manner (for example, don't scan while driving).
- Verify every parking decision against the physical sign before leaving your vehicle.
- Obey all applicable traffic laws, parking regulations, and council rules regardless of what Park Sorted says.
- If you use the iPhone app, not use it in any way that violates the App Store Terms of Service or Apple's Developer Program Licence.
- Not scrape, reverse engineer, or attempt to extract the vision model or its outputs at scale.
6. Fines, tows, and other parking outcomes
If you get a parking fine, tow, clamp, or other enforcement outcome while using Park Sorted, that's on you, not us. We did our best to interpret the sign; you're the one who chose to park. Section 9 (“Limitation of liability”) is where this is locked down in lawyer language — read it.
7. Intellectual property
Park Sorted — including the app, the website, the logo, the verdict layouts, and the underlying prompt engineering — is our intellectual property and the property of our licensors. You get a personal, non-transferable, revocable licence to use the App for your own parking decisions. You don't get rights to copy, redistribute, resell, sublicence, or create derivative works.
8. Warranty disclaimer
Park Sorted is provided “AS IS” and “AS AVAILABLE”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant that:
- The App will be error-free or uninterrupted
- The verdicts will be accurate
- The App will be compatible with any particular device or iOS version
- Defects, if any, will be corrected
Consumer guarantees under Australian Consumer Law still apply and cannot be excluded. Nothing in these Terms attempts to exclude or limit rights that cannot be excluded by law.
9. Limitation of liability
To the maximum extent permitted by law:
- We are not liable for any parking fine, towing fee, clamping fee, impounding fee, or other parking-enforcement cost you incur while using Park Sorted.
- We are not liable for indirect, incidental, consequential, special, or punitive damages arising from your use of the App.
- Our total aggregate liability to you for any and all claims arising from or relating to Park Sorted is capped at the greater of (a) the amount you paid us for the App in the 12 months preceding the claim, or (b) AUD $50. The App is currently free — that means the cap is usually AUD $50.
The above limitations apply even if we have been advised of the possibility of such damages and even if a remedy fails of its essential purpose.
10. Indemnity
You agree to indemnify and hold us harmless from any claim, loss, liability, or expense (including legal fees) arising out of your use of the App, your violation of these Terms, or your violation of any law or the rights of a third party.
11. Termination
You can stop using Park Sorted at any time by deleting the App.
We can stop offering Park Sorted, or suspend or discontinue any feature, at any time and without notice. If we do, Sections 7, 8, 9, 10, and 12 survive termination.
12. Governing law and disputes
These Terms are governed by the laws of New South Wales, Australia. The courts of New South Wales have exclusive jurisdiction over any dispute arising from or relating to Park Sorted or these Terms.
Before formal legal action, you agree to contact us at support@parksorted.com and give us 30 days to resolve the dispute informally.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we'll update the “Last reviewed” date and notify you in the App on next launch. Continued use of the App after a change means you accept the new Terms.
